IMPORTANT: By commissioning Avento Drones, placing an order, accepting a quotation, or requesting a flight shoot, you ("The Client") unreservedly agree to be legally bound by the terms of this Flight Services Agreement.
1. Binding Contractual Agreement: Any instruction, booking confirmation, quotation acceptance, or commission given to Avento Drones ("The Operator") constitutes a legally binding contract incorporating these Terms & Conditions. No variation of these terms shall apply unless agreed in writing by Avento Drones.
2. CAA Regulations & Pilot Authority: All flight missions strictly comply with UK Civil Aviation Authority (CAA) regulations under GVC / A2 CoC remote pilot qualifications. The remote pilot in command holds absolute statutory authority to pause, postpone, alter, or cancel any flight if safety, airspace restrictions, or weather hazards compromise flight operations.
3. Weather Postponements & Rescheduling: Drone flight operations are weather-dependent. Precipitation, freezing conditions, or wind speeds exceeding equipment thresholds constitute valid grounds for flight suspension. If a shoot is postponed due to weather, Avento Drones will reschedule to the next mutually available clear date at no additional fee.
4. Client Obligations & Site Access: The Client warrants that they possess full legal authority and have secured all necessary landowner permissions and site access rights for the designated flight area. The Client agrees to indemnify Avento Drones against any third-party claims arising from unauthorized site access.
5. Insurance & Liability: Avento Drones maintains £1,000,000 (£1M) Aviation Public Liability Insurance compliant with UK Regulation (EC) No 785/2004. Total liability of Avento Drones under any claim shall not exceed the total contract price paid by the Client for the service.
6. Copyright & Licensing: Under the Copyright, Designs and Patents Act 1988, Avento Drones retains statutory copyright ownership of all captured media. Upon receipt of payment in full, the Client is granted a non-exclusive, perpetual license to use and publish the deliverables for their commercial, marketing, and media purposes. Media usage rights remain withheld until full invoice settlement.
7. Payment Terms & Delivery: Deliverables are supplied digitally within 48 hours of flight completion unless custom editing is specified. Invoice payment terms are strictly 14 days from date of invoice.
